We partner with multiple third-party service providers such as airlines, hotels, and global distribution systems (GDS) to enable customers (“You”, “Your”, “Clients”, or “Travel Agents”) to book travel arrangements.
While we strive to ensure that our customers enjoy seamless services, there may arise unfortunate situations where an airline, hotel, or other supplier becomes insolvent, bankrupt, financially distressed, or ceases operations entirely. In such situations, the financial control and operational responsibility rest exclusively with the respective service provider, and not with HRT Vacations Pvt. Ltd.
This Refund Policy outlines our position, obligations, and limitations in handling refund claims in such extraordinary circumstances.
HRT Vacations Pvt. Ltd. is an intermediary and does not own or operate airlines, hotels, or related third-party services.
All bookings are made on behalf of the customer with the concerned service provider. Therefore, the ultimate liability for service delivery, cancellations, or refunds lies with the service provider.
In the event of insolvency, bankruptcy, suspension, or operational shutdown of the service provider, HRT Vacations Pvt. Ltd. shall not be held liable or responsible to compensate, refund, or reimburse any amounts paid by the customer at the time of booking.
This Refund Policy applies in the following scenarios:
Airline Insolvency or Bankruptcy: Where the airline suspends its operations, files for bankruptcy, or ceases flights.
Hotel Insolvency or Closure: Where the hotel ceases operations, is declared bankrupt, or is unable to provide services due to liquidation or closure.
Supplier / Consolidator Default: Where any consolidator, supplier, or third-party partner through whom the booking was processed becomes insolvent or ceases operations.
In the event of such insolvency or bankruptcy, no automatic refund will be issued by HRT Vacations Pvt. Ltd.
Customers, clients, or travel agents acknowledge and agree that they shall not hold HRT Vacations Pvt. Ltd. responsible or liable for refund obligations originally promised by the airline, hotel, or supplier.
The financial risk of insolvency of a third-party service provider rests solely with the customer at the time of booking.
In certain cases, HRT Vacations Pvt. Ltd. may, at its sole discretion, attempt to process a refund if assurances, commitments, or refund authorizations are received from the concerned airline, hotel, or supplier.
Any refund processed by HRT Vacations Pvt. Ltd. under such discretionary grounds shall be considered as an ex-gratia payment and not as a legal or contractual obligation.
If such refund is processed and later it is discovered that the supplier has become insolvent, bankrupt, or non-operational, the Company reserves the right to recover such refunded amounts from the customer. Recovery may be carried out by adjusting against future bookings, issuing debit notes, or initiating appropriate legal proceedings if necessary.
Customers are strongly advised to purchase travel insurance or trip protection plans that specifically cover risks of airline or hotel insolvency.
Customers must carefully read the terms and conditions of airlines, hotels, and other suppliers before confirming their bookings.
In case of insolvency, customers should directly contact the concerned airline, hotel, or supplier for claims, chargebacks, or alternative remedies.
If the booking was made via a travel agent or sub-agent, the responsibility of liaising with the end customer lies with the respective travel agent.
HRT Vacations Pvt. Ltd. shall not be liable for any direct, indirect, incidental, or consequential losses suffered by customers due to insolvency or bankruptcy of airlines, hotels, or suppliers.
The Company shall not be liable for loss of time, emotional distress, inconvenience, missed connections, or consequential damages arising from such events.
The maximum liability of HRT Vacations Pvt. Ltd., if any, shall be limited strictly to the extent of service fees (if any) directly collected by the Company for facilitating the booking.
Insolvency or bankruptcy situations often arise due to extraordinary and unforeseeable circumstances beyond anyone’s control, including but not limited to:
Economic downturns, financial mismanagement, or corporate fraud by the service provider.
Global pandemics, government restrictions, or sudden policy changes.
Natural disasters, wars, terrorism, or political unrest.
HRT Vacations Pvt. Ltd. shall treat such insolvency cases under the Force Majeure principle, and customers expressly agree that the Company is not liable for performance failures caused by these uncontrollable events.
If a booking was made through online payment gateways or banking channels, any refund claim arising from service provider insolvency must be pursued directly with the respective bank or payment gateway under their dispute resolution process.
The Company shall provide reasonable support documents (such as booking confirmations, invoices, or cancellation notices) to help the customer initiate chargebacks or claims but shall not be responsible for the outcome.
By confirming a booking with HRT Vacations Pvt. Ltd., customers, clients, and travel agents acknowledge and accept this Refund Policy.
